The law has changed.
Digital Waste Tracking is mandatory for permitted waste receiving sites in England and Wales from 1 October 2026. It becomes mandatory in Scotland and Northern Ireland in January 2027. You must record each receipt of waste and send that movement to Defra using approved software. A Digital Waste Tracking record is not a waste transfer note — you still need those — and regulators can spot gaps in real time.
The Risk
Non-compliance carries real penalties. Regulators can issue fixed fines of £1,000 (rising to £1,500 if paid late), or variable fines with no cap in England (up to £40,000 in Scotland) for serious or repeated breaches — plus enforcement costs and, in the worst cases, criminal prosecution with unlimited fines.
